Terms of Use (Consent Required)
Chapter 1: General Provisions
Article 1 (Purpose)
These Terms of Service are intended to define the basic matters—including the rights, obligations, and responsibilities of members and the clinic, as well as the conditions and procedures for use—regarding members’ use of the services provided by Forever Clinic (hereinafter referred to as the “Clinic”) (http://www.4-ever.co.kr/).
Article 2 (Effectiveness and Amendment of the Terms and Conditions)
① These Terms and Conditions apply to all members who wish to use the service.
② The contents of these Terms and Conditions shall be posted on the service screen or disclosed to members by other means, and shall take effect when a member who has agreed to them registers for the service.
③ The clinic may amend these Terms and Conditions when deemed necessary, and in the event of such amendments, will announce them without delay in the manner described in Paragraph 2. However, amendments to important provisions concerning users’ rights or obligations will be announced at least 7 days in advance.
④ If a member does not agree to the amended terms and conditions, they may discontinue use of the service and terminate the user agreement.
Article 3 (Rules Outside the Terms and Conditions)
Matters not specified in these terms and conditions shall be governed by the provisions of the Medical Service Act and other relevant laws and regulations.
Article 4 (Definition of Member)
A person who has gained member status and privileges by accessing the site and providing required information such as their name and email address
Chapter 2: Terms of Service Agreement
Article 5 (Establishment of the User Agreement)
When a customer clicks the “Agree” button in response to the question “Do you agree to the Terms of Service above?” during the sign-up process, they are deemed to have agreed to the terms.
Article 6 (Application for Use)
To apply for service—that is, to sign up—customers must enter the following information on the registration form.
- ID
- Password
- Name
- Phone Number
- Availability
Article 7 (Approval of Application for Use)
The clinic approves service applications from customers who have accurately provided the information specified in Article 6.
Article 8 (Restrictions on Approval of Applications for Use)
The clinic may refuse to approve applications that fall under any of the following categories.
- In cases where service provision is technically impossible
- If you provide false information during user registration, such as using a name other than your own or using another person’s name,
- If you submit an application with missing or incorrect registration information
- If the application undermines or is intended to undermine public order or public morals
- If you have ever lost your membership status due to your own fault.
- If other application requirements set by the hospital are not met
- Membership registration will be suspended only if consent to the Terms of Service and Privacy Policy is not provided.
Article 9 (Changes to Contractual Terms)
If any information provided by a member at the time of registration changes, the member must update it using the designated form and method established by the clinic.
Chapter 3: Using the Service
Article 10 (Purpose and Scope of Service Provision)
The clinic operates this service free of charge to provide information about the medical services it offers. All services, except for surgery reviews, can be viewed without registering as a member. In accordance with the Medical Service Act, surgery reviews are available only after registering and logging in.
Article 11 (Commencement of Service Use)
② In the event that services cannot be provided due to operational or technical issues at the clinic, we will post a notice on the website or notify members accordingly.
① As a general rule, the clinic begins providing services upon approval of a member’s application.
Article 12 (Service Availability Hours)
① In principle, the service is available 24 hours a day, 365 days a year. However, the service may be temporarily suspended due to operational or technical reasons at the clinic, and it may also be temporarily suspended during periods designated by the clinic for operational purposes. In such cases, the clinic will provide notice either in advance or afterward. (Note: The “KakaoTalk Consultation” and “Phone Consultation” services under the “Medical Appointments” category are excluded from the above provision.) ② The clinic may divide the service into specific categories and set separate operating hours for each category; in such cases, it will announce the details accordingly.
Article 13 (Deletion of Posts or Content)
① The clinic may delete, without prior notice, any content posted or transmitted by members within the service (including communications between members) if it determines that such content falls under any of the following categories, and the clinic assumes no liability in this regard.
- Content that defames the clinic, other members, or third parties, or damages their reputation through slander
- In cases involving the dissemination of information, text, graphics, or other content that violates public order and morals
- In cases where content is deemed to be associated with criminal activity
- If the content infringes on the clinic’s copyright, third-party copyrights, or other rights
- If the content is unrelated to the services provided by the clinic
- If you post unnecessary or unauthorized advertisements or promotional materials,
- If the content was created by unauthorized use of another person’s ID (resident registration number), name, etc., or if it involves the unauthorized alteration or forgery of information entered by another person,
- In cases where the purpose of the post is not met, such as posting the same content multiple times
- If it is determined to violate other relevant laws and regulations or the hospital’s guidelines, etc.
② The clinic may separately establish and enforce detailed usage guidelines related to posts, and members must post or delete all types of content (including messages exchanged between members) in accordance with those guidelines.
Chapter 4: Standards for Disclosure of Information
Article 14 (Definition of Data Disclosure)
As this service is provided free of charge for the public benefit purposes described in Article 10 of Chapter 3, the hospital may disclose the following information.
① Information regarding the techniques and medications used during surgery
② Patient reviews published with the consent of our patients (available after logging in)
Article 15 (Methods of Disclosing Information)
As a general rule, the method of disclosing information that may be disclosed, as specified in Article 14 of Chapter 4, shall be based on the following criteria.
① How to post using this website or other websites
② How to publish by inserting into print media or promotional materials
③ How to post content via in-clinic video displays
④ Posting methods determined by the hospital, provided they do not violate social norms and public morals
Chapter 5: Damages, etc.
Article 16 (Compensation for Damages)
① If the clinic suffers damages as a result of a member’s violation of the provisions of these Terms and Conditions, the member who violated these Terms and Conditions shall compensate the clinic for all damages incurred.
② If the clinic receives any claims for damages, lawsuits, or other disputes from third parties other than the member in question due to illegal acts committed by the member while using the service or violations of these Terms and Conditions, the member must indemnify the clinic at their own expense and liability. If the clinic is not indemnified, the member must compensate the clinic for all damages incurred as a result.
Article 17 (Disclaimer)
① The clinic shall be exempt from liability for the provision of services in the event that it is unable to provide such services due to natural disasters or other force majeure events of a comparable nature.
② The clinic is not liable for any service disruptions caused by the member’s own fault.
③ The clinic assumes no liability for any loss of profits that a member may incur as a result of using the service, nor does it assume liability for any damages arising from materials obtained through the service. The clinic assumes no responsibility for the content—including the reliability and accuracy—of any information, materials, or facts posted by members on the site.
④ The clinic has no obligation to intervene in disputes arising between members or between members and third parties in connection with the service, nor is it liable for any damages resulting therefrom.
Article 18 (Jurisdiction)
① In the event of a dispute between the clinic and a member regarding the use of the service, the clinic and the member shall consult in good faith to resolve the dispute.
② If the dispute is not resolved through the consultations referred to in Paragraph 1 of this Article, either party may file a lawsuit with the competent court under the Civil Procedure Act.
Supplementary Provisions (March 24, 2021)
(Effective Date) These Terms and Conditions are effective as of March 24, 2021.
